Alec Baldwin FORCED Back Into Trial Over Shooting

A California judge ruled that Alec Baldwin must face a civil trial on negligence charges stemming from the deadly 2021 Rust film set shooting that killed cinematographer Halyna Hutchins, marking a significant legal setback for the Hollywood actor despite his earlier criminal case dismissal.

Judge Allows Negligence Claims to Proceed

Serge Svetnoy, who worked as a gaffer on the Rust production, filed the lawsuit claiming Baldwin’s actions caused severe emotional distress when a live round was discharged from a prop gun the actor was holding. Svetnoy alleges the bullet narrowly missed him during the fatal incident. The judge dismissed an assault claim but allowed negligence and intentional infliction of emotional distress charges to move forward. The court determined that a reasonable jury could find Baldwin owed a duty of care to crew members positioned in the weapon’s line of sight.

Baldwin has consistently maintained he never pulled the trigger on the firearm. The shooting also wounded Rust director Joel Souza, who has since recovered from his injuries. Hannah Gutierrez-Reed, the film’s armorer responsible for weapon safety, was convicted of involuntary manslaughter and served an 18-month sentence before her release. Baldwin’s own criminal prosecution collapsed when a judge ruled prosecutorial misconduct prevented a fair trial, barring any future criminal charges on the same matter.

Settlement History and Legal Outlook

Several other civil lawsuits connected to the tragedy, including claims filed by Hutchins’ husband and additional crew members, reached confidential settlements before reaching trial. None of those agreements included admissions of wrongdoing by any parties. Legal expert John Day noted that most civil cases settle before trial, though the outcome of Baldwin’s case remains uncertain. Neither Svetnoy’s legal team nor Baldwin’s representatives have provided public comment on the judge’s decision.

What This Means

The ruling establishes that Baldwin can be held civilly liable for on-set safety regardless of criminal prosecution outcomes. The case reinforces that actors handling firearms bear responsibility for ensuring those weapons pose no danger to crew members. While the timeline for trial remains unclear, the decision opens Baldwin to potential financial damages and keeps the October 2021 tragedy in public focus. The case could set a precedent for how courts evaluate actor responsibility in prop weapon incidents on film productions nationwide.

  1. It was never supposed to be an actual gun, just a fake.Hannah had been fired just two months before,on a different movie set for AGAIN replacing a prop gun with a loaded actual gun that fired while still on the cart, but no one was shot during that case.Real nut case, that girl!

  2. I’m no expert, but I have never heard of a gun spontaneously firing itself. How a live round found it’s way into the chamber, I don’t know, but I’m guessing someone put it there. I’m guessing Hannah what’s her name. Perhaps Alex doesn’t remember firing the gun from all this trauma, but his finger pulled the trigger. I’ve been told by folks who do know guns that you always check a gun before firing it the first time whether you think you know what’s what with it.
